Monday Myth Buster – Are Employment Tribunal fees coming back?

Question:  I’ve heard that Employment Tribunal fees are going to be re-introduced. Is that correct?

Answer:  The short answer is …. maybe.

The Ministry of Justice (MoJ) have said that a fee paying system could be re-introduced for those people who can afford to pay the fees, and that those that cannot afford to pay, they would not have to. You may well be shouting “but wasn’t this the situation before?” – and you would be right. There was a remission certificate scheme and there are discussions taking place to re-introduce this too for those people who cannot afford to pay the fees. You may recall that Employment Tribunal fees were abolished in 2017 which lead to an almost 100% increase in the number of Employment Tribunal claims being issued, leading to the MoJ needing to recruit a significant number of new judges to help deal with the backlog of cases. This has now re-ignited the fees discussion ………..
