This Working Time Directive 48 hour opt out form should be used where workers agree to work longer than the 48-hour limit. This document is in open format so that you can adjust it to suit your purposes.

The employee can opt out for a specified period such as working on a project or for unlimited period of time .

The Working Time Directive Regulations 1998 prevents workers from being forced to work for more than 48 hours a week on average.

This average weekly working time is normally calculated over  a 17 weeks period, but this can be changed on agreement.

Young Workers are not able to opt out of the limits on working hours. A Young Worker is defined as someone who is still at compulsory school age and are not yet 18. They may not work more than 8 hours a day or 40 hours a week, although there are exceptions which we are able to advise on.

A worker can cancel their decision to pot out of the average 48 hour working week at any point, although they should give at least seven days’ notice.

You cannot lawfully be penalised, victimised, disciplined, or subjected to any other detriment, for refusing to sign an agreement opting out of the 48-hour working week.
